2. Eligibility & Account
You must be at least 13 years old (or the age required by your local law) to use the App. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
3. Health & Safety Notice
LucidWave is a wellness and relaxation tool. It is not a medical device and does not diagnose, treat, cure, or prevent any disease or condition.
Consult a qualified healthcare professional before using LucidWave if you have any medical condition, are pregnant, use implanted or wearable medical devices, have a history of seizures or photosensitivity, or have concerns about light/sound exposure.
4. License & Acceptable Use
LucidWave grants you a personal, revocable, non-exclusive, non-transferable license to use the App on Apple-branded devices you own or control, subject to these Terms and the Apple App Store Terms. You agree not to: (a) copy, modify, or create derivative works of the App; (b) reverse engineer or attempt to extract the source code; (c) use the App in a way that violates any law or infringes any rights; (d) circumvent access or security controls.
5. Subscription Terms (Auto-Renewable)
The App offers an auto-renewable subscription for premium features:
- Title: LucidWave Premium Annual
- Length: 1 year
- Free Trial: 1 month free
- Price: $5.99 (USD) per year. Pricing may vary by region and currency.
- Auto-Renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
- Billing: Your Apple ID account will be charged upon confirmation of purchase, and for renewal within 24 hours prior to the end of the current period.
- Manage / Cancel: You can manage or cancel your subscription at any time in your Apple ID Account Settings on your device (Settings > [your name] > Subscriptions).
- Trial Conversion: After the 1-month free trial, the subscription converts to a paid annual plan unless cancelled before the trial ends.
These subscription terms are also presented within the App’s paywall prior to purchase.
6. Payments, Refunds & Taxes
Payments are processed by Apple via the App Store. Refunds, if any, are provided at Apple’s discretion under App Store policies. You are responsible for any applicable taxes. For questions regarding billing or refunds, please see Apple’s support resources.
7. Privacy
Your use of the App is subject to our Privacy Policy, which explains how we collect, use, and share information.
8. Intellectual Property
All content and materials in the App are owned by or licensed to LucidWave and are protected by intellectual property laws. No rights are granted except as expressly set forth in these Terms.
9. Disclaimers & Limitation of Liability
The App and all content are provided “as is” and “as available” without warranties of any kind, express or implied. To the maximum extent permitted by law, LucidWave disclaims all warranties, and is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill.
10. Apple EULA & Third-Party Terms
Use of the App is also subject to Apple’s Standard End User License Agreement (EULA). In the event of a conflict between these Terms and the Apple EULA, the Apple EULA controls where required by Apple’s policies.
11. Termination
We may suspend or terminate your access to the App if you violate these Terms or use the App in a manner that may cause harm. You may stop using the App at any time. Termination does not affect rights and obligations that have accrued, including outstanding payment obligations.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice within the App or on our website. Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms.
